Privacy Policy

This policy explains how we collect, hold, use and disclose personal information, consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). It covers the ClearVine marketing website, the ClearVine application, and our communications with you.
1. What we collect
Account and identity information. When you sign in, authentication is handled exclusively by Microsoft Entra ID. We receive and store your name, email address and a Microsoft account identifier. We do not receive, store, or have access to your password.
Access requests and enquiries. When you request access via our website or email us, we collect the details you provide: name, business name, email address and role.
Operational records you enter. The application stores the vineyard records you and your authorised users create: businesses, vineyards, blocks, spray and nutrition applications, observations (including photos you take), growth stages, yields, equipment and calibration details. Some of these records include personal information about operators — for example an operator's name, email address and chemical-handling licence number attached to a spray record, as required for compliance record-keeping.
Billing information. Subscription and billing status. If and when card payments are enabled, payments will be processed by a dedicated payment provider (such as Stripe); we do not store card numbers ourselves.
Technical information. Standard service logs and telemetry — IP addresses, browser/device information, pages and features used, and error diagnostics — used to secure and improve the service.
Weather and public data. The service uses weather observations from government stations (e.g. WA DPIRD) and published regulatory reference information. These are not personal information.
2. How we collect it
Directly from you (forms, records you enter, correspondence); automatically when you use the service (logs, telemetry, authentication events); and from your business's administrator when they invite you as a user (your name and email).
3. Why we collect it
We collect, hold and use personal information to: provide and operate ClearVine (including generating your records, reports and compliance outputs); create and manage accounts and invitations; respond to access requests and support; process subscriptions and billing; send service and account communications; maintain security, audit trails and record integrity; comply with our legal obligations; and improve the service. We may use de-identified, aggregated data (which no longer identifies anyone) for analytics and benchmarking, subject to the de-identification safeguards described in our Terms of Service.
Marketing. We may send you information about ClearVine features and updates if you have requested access or subscribed. Every marketing email includes an unsubscribe option, and we will stop on request. We do not sell personal information.
4. Who we disclose it to
We do not sell or rent personal information. We disclose it only to the service providers who help us run ClearVine, to the extent needed for them to provide their service to us:
• Microsoft — application hosting, database, authentication (Entra ID) and email delivery for operational messages (Azure and Microsoft 365 services).
• Cloudflare — website hosting, content delivery, and network security in front of our services.
• Resend — delivery of website emails (e.g. access-request confirmations).
• Google — web fonts on our website; map tiles in the application (block locations are shown on Google Maps).
• Stripe — payment processing, if and when card payments are enabled (not currently active; we will update this policy when they are).
We may also disclose personal information where required or authorised by law, to our professional advisers under confidentiality, or as part of a genuine sale or restructure of our business (in which case this policy continues to apply to the transferred information).
Your business controls its workspace. Records you enter in a business's ClearVine workspace are visible to that business's authorised users according to the roles its administrators set. Reports a business exports or sends (for example, a spray record emailed to an operator, or a report pack given to a buyer or auditor) are disclosures made by that business, not by us.
5. Overseas storage and disclosure
Our hosting and service providers store and process data in data centres that may be located outside Australia — including Microsoft Azure regions in Southeast Asia (Singapore), and Cloudflare, Resend, Google and Stripe infrastructure in the United States and globally. Where personal information is handled overseas, we take reasonable steps as required by APP 8 to ensure the recipient handles it consistently with the APPs — principally through these providers' contractual data-protection and security commitments and our configuration of their services. By using ClearVine you acknowledge that your information may be stored and processed in these locations.
6. How we protect it
Reasonable security measures we maintain include: sign-in exclusively through Microsoft Entra ID (no passwords held by us); encryption of data in transit (TLS) and at rest; per-business access controls so each customer's workspace is isolated; role-based permissions within a workspace; a tamper-evident change history on records (before/after images of edits); rate limiting and network-edge protection; and audit logging. No system is perfectly secure, but if a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the OAIC in accordance with the Notifiable Data Breaches scheme.
7. Cookies and local storage
The application uses essential authentication cookies (set by Microsoft Entra ID / our application host) to keep you signed in, and browser local storage to remember your session preferences (such as your active business). The marketing website does not use advertising trackers. Blocking essential cookies will prevent sign-in.
8. How long we keep it
We keep personal information for as long as your account or your business's workspace is active, and afterwards as described in our Terms of Service: records remain exportable for at least 12 months after a subscription ends, after which they may be deleted or de-identified on notice — except where the law requires longer retention. Compliance records (such as spray records) can carry statutory retention periods; the business that owns the workspace is responsible for retaining its exported records for the periods that apply to it.
9. Access, correction and complaints
You may request access to, or correction of, the personal information we hold about you by emailing sean@swagritech.com.au. We will respond within a reasonable time. Most operational records can be viewed and corrected directly in the application by your business's authorised users.
If you have a privacy complaint, contact us first and we will investigate and respond. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
10. Changes to this policy
We may update this policy from time to time. The current version will always be published at clearvine.com.au/privacy with its last-updated date. For material changes we will notify account holders by email.
